Our foreign exchange student that is living in our home this school year wishes to come back & finish her high school career next year without being a part of the foreign exchange program that she is currently participating in. A temporary guardianship under Texas Law would require a court proceeding and the posting of a bond and is likely to be more expensive than if the child were to just stary in the exchange student program. There are two separate issues here. First, can she obtain the F1 student visa to return to the US and attend school? Many private schools have authorization to admit international students and help them obtain the F1 student visa. Many public schools do not.
She cannot continue with an exchange visitor visa unless she moves to a different program that has authorization to issue documentation used for the J1 package.Second for guardianship issues, you may want to consult with a lawyer specializing in family law. You may be able to get information about guardianship from the clerk's office in the country courthouse.
